General Terms and Conditions of access and use

This Legal Notice regulates access to and use of the various contents and information included in or accessible through the web site, www.aerisco.com (hereinafter, the web site), owned by ROOT AERISCO, S.L. (hereinafter, AERISCO). For merely using the web site, you acquire the condition of user. Use of the web site and of any of the services of the same means that you agree as the user, without any reservation, to all these general conditions and to any particular conditions that may be in force, if applicable.

User's obligations
1. Users are hereby bound, in general, to use both the web site and the content, services and information linked to the same, diligently and in accordance with the law, with moral standards, with public order and with the provisions set forth in this Legal Notice, and users must likewise abstain from using them in any way that may prevent the web site’s other users from the normal operation and use of the content of the same or that may harm or cause damage to the assets and rights of AERISCO, of its suppliers, of its users or, in general, of any third party. More specifically, but without hereby limiting the general scope of the obligations set forth in the preceding sentence, users are bound, when using the web site and the services linked to the same, to:

Not introduce, store or distribute, through the web site or through any of the services linked to the same, any computer program, data, virus, code or any other electronic instrument or device that may be likely to cause damages to the web site, to any of the services linked to the same or to any equipment, systems or networks of AERISCO, of any user, of any of AERISCO's suppliers or, in general, of any third party, or that, in any other way, may be capable of causing any type of alteration to them or preventing the normal operation of the same.
Not to use false identifies or impersonate the identity of others for use of the web site or of any of the services linked to the same, including the use, if applicable, of the passwords or access codes of third parties or the use of passwords or access codes in any other way.
Not to destroy, alter, make unusable or damage the electronic data, information, programs or documents of AERISCO, of its suppliers or of third parties.
Not to use the content, particularly the information obtained through the web site, to forward advertising, send messages for commercial purposes or collect or store the personal data of third parties.

Intellectual and industrial property
2. The user acknowledges that all elements of the web site; the information and materials contained in the same; the structure, selection, ordering and presentation of the content thereof; and the computer programs used in relation to the same are protected by the intellectual and industrial property rights of the AERISCO itself or of third parties.

3. Unless the user is authorised by AERISCO or, if applicable, by the third parties who may own the corresponding rights or at least may be legally permitted, the user may not reproduce, transform, modify, disassemble, do reverse engineering on, distribute, lease, provide, make available to or allow public access to, through any public communication mode, any of the elements referred to in the preceding paragraph.

4. Users must use the materials, elements and information that they access through using the web site solely for their own needs, and they are hereby bound not to make commercial use, either directly or indirectly, of either the services or of the materials, elements and information obtained from the same.

5. Users must abstain from eliminating the identifying signs of the rights (of intellectual or industrial property or any other) of AERISCO or of the third parties that may be included in the web site and in the content offered through the same.

6. Likewise, users must abstain from avoiding or manipulating any technical devices established by AERISCO or by third parties, either on the web site or in any of the materials, elements or information obtained through the same, for the protection of their rights.

Passwords
7. AERISCO will facilitate the use of personal passwords for users who register as such with respect to certain services provided through the web site. Users must keep passwords in the strictest and absolute confidentiality under their own responsibility, thereby assuming all damages and consequences of any kind that may be derived from a violation or revelation of the secret. For security reasons, the password for telematic access to the services linked to the web site may be modified by users.

Communications
8. Users hereby give their consent so that AERISCO may send them commercial communications referring to its products or services, either by e-mail, by postal mail or by any other means, and they may request, at any time, that these communications cease to be sent. To do so, and to make any other consultation or comment, users may address AERISCO via postal mail or email.

Disclaimer of warranties
9. AERISCO undertakes to make every necessary effort to guarantee the availability and continuity of both the web site and the services linked to the same. Nevertheless, AERISCO cannot guarantee that the web site and the services linked to the same will work correctly at all times or that users can access them and use them quickly, without interruption and free from errors. Likewise, AERISCO does not grant any warranty with respect to the suitability and content of the web site or of any of the services linked to the same for satisfying the specific needs of users.

10. AERISCO will act diligently according to generally accepted uses in the sector to prevent the presence at the web site or in any of the services linked to the same, of viruses or other harmful elements that could cause alterations to the computer system or the electronic documents or files of users, but it cannot guarantee the absence of such elements and may not be held liable for the damages that could be caused by the same.

11. AERISCO does not control or endorse or guarantee the accuracy, quality, veracity, reliability or suitability of the information and services provided or rendered by third parties through the web site. Likewise, it does not control or guarantee the absence of viruses or other harmful elements in the content or services provided or rendered by third parties through the web site.

12. AERISCO does not guarantee the technical availability, quality, reliability, accuracy or veracity of the content and services available at sites that belong to or are managed by third parties and that users may access through links from this web site. AERISCO does not control the content of said web sites or offer or market the products and services that are available at the web sites that are thus linked, nor does it consequently assume any liability for the same.

Termination
Without prejudice to the liability for damages that could be derived, AERISCO may, immediately and without the need for prior notice, terminate and deem its relationship with users to be ended, thereby interrupting their access to the web site or to the corresponding services thereof, if it detects use of the same or of any of the services linked to the same that may be contrary to the general or particular conditions that may be applicable.

1. Scope of contract - These General Terms and Conditions are applicable to any purchase of products from Root Aerisco S.L. (Aerisco from now on) either by telephone, email or through our virtual store, by professionals, COMPANIES, consumers, users or any kind of end user (THE USER), to whom orders may be delivered within the Spanish territory or abroad as described in clause 6. The usage of the services provided by Aerisco presupposes that in any event the USER has adhered to the version of the General Terms and Conditions published by Aerisco at the time of placing the order request, which is a available to customers on the website. Therefore we advise our customers to carefully read our General Terms and Conditions before placing an order request. So, if THE USER clicks "I have read and I accept the GTC" on the shopping basket, it will be considered that THE USER fully understands and agrees to be bound by them. On the other hand, should THE USER not accept this General Terms and Conditions, the transaction will not be completed and there will no obligation on behalf of THE USER. Once an order request has been placed through our website, THE USER will receive and acknowledgment email confirming that the order request has been successfully registered.

2. Prices, payment methods, deliveries, availability and product returns

2.1. Prices - All prices displayed on screen below each product are based in Euros and may include taxes or not as indicated. European companies (out of Spain) with valid VAT number and companies or individuals out of European Union will be VAT exempted. In the shopping basket the total amount to pay excluding taxes is displayed separately, along with the applicable shipping costs. Shipping costs are NOT included in product prices, as they will be calculated based on the number of products selected, their warehouse and the final delivery destination. Some payment methods may have associated and additional handling fee. Both the shipping costs and any applicable handling fee will be displayed once THE USER has signed in and has chosen a payment method. In any case, an explanatory note will appear before THE USER places the order request. Unless otherwise stated, products subject to a private copying levy in accordance with Article 25.21 of the Royal Legislative Decree 1/1996 of 12 April 1996, approving the consolidated version of the Intellectual Property Law, include the fee in the selling price. Offers will be properly marked and identified as such. Aerisco reserves the right to make the changes it deems necessary and can update products prices daily and depending on market prices, at any time and WITHOUT prior notice. The price applicable to the USER request will be the one stated at the time of accepting the General Terms and Conditions. Before CONFIRMING the order, Aerisco reserves the right to notify the USER of any error in the order price. Shall the final price greatly differ from the one initially indicated, the USER has the OPTION to cancel the order request, being refunded any paid amount and being offered product alternatives. The prices for international sales are subject to the provisions of clause 6. Shipping costs to destinations other than mainland Spanish and the Balearics are approximate and may vary depending on the volume of the products in the order request and specific requirements for international shipments. In this case the Aerisco staff will contact the USER to notify the final price and request authorization to process the order request with the new conditions.
2.2. Payment methods - All the Order Requests that Aerisco has accepted may be paid by a wire transfer to any of the bank accounts provided by Aerisco. It's also possible to pay an order in advance, when placing an order request, either by PayPal (if allowed by the selected products) or any of the following credit cards: VISA, MasterCard or any other credit card mentioned in the basket. In this case the USER accepts that PayPal or the bank operating the payment gateway will charge in advance the total amount indicated in the Shopping Basket. For security reasons, in case the personal details provided to Aerisco differ from the ones in the PayPal account used, Aerisco reserves the right of refusing the payment and cancelling the Order Request, especially if there is strong evidence that the buyer is not the PayPal account holder. For security reasons, Aerisco may request the USER to submit a copy of an identification card or any other document proving the identity of the USER when paying by credit card, either manually or online. Aerisco reserves the right of refusing the payment and cancelling the Order Request, if there is reasonable doubt that the buyer is not the provided credit card holder and the USER refuses to use an alternative payment method after having been informed. The USER may cancel any ORDER REQUEST before his ORDER being confirmed. Should the ORDER be already confirmed, either by email or by any other means of communication, the conditions stated in paragraph 2.4 of these General Terms and Conditions will be applied.
2.3. Deliveries and Availability- Expected delivery times and availavility dates published depend on the products and the warehouses where they are stored. The expected delivery time can be found in product detail and cart pages. Once the payment for an order has been confirmed and the availability of the requested products have been confirmed, the orders will be dispatched from Aerisco warehouses or wholesalers to the delivery address provided by the USER, within 1-2 business days. Should the USER not receive the ORDER within the delivery time published in the cart/checkout page, please contact our Customer Service either by chat, phone 902014561 or the contact form: https://aerisco.com/en/support/open-ticket-support. All efforts will be made by Aerisco to ensure that the delivery times are met and in the event of being unable to do so, the USER will be promptly informed by phone or email. Aerisco will do everything possible but CAN NOT GUARANTEE that, unless otherwise stated, the USER will receive the products within 4 days in mainland from the date the products are shipped from the warehouse. Most products will be delivered by specialized carriers. In the event that the USER requires a faster delivery service, and only if it is possible to offer such service, Aerisco will do the necessary arrangements and will inform the USER of the additional costs associated with the service. Some products can only be delivered to mainland Spain and The Balearic Islands. Upon receiving an Order Request from a zone where it is not possible to dispatch the requested products, Aerisco will promptly inform the USER. Sometimes, in orders including more than one product, different shippings can be arranged. A single delivery with all the available products or several deliveries: one with the currently available products and second one or serveral ones with the remaining products once they become available. In the second case, the USER will not have to pay for the additional cost of the second delivery if he has not requested it.
A product is marked as available if it's in our own warehouses or our providers have confirmed there is available stock in their warehouses. The availability information is automatically updated several times at day and, unless otherwise stated, it is not updated until the following day. Under some circumstances, like the demand of a product exceeding our expectations, a product may not available while placing an order request. Aerisco staff will inform the USER of the unavailability of a product as soon as we receive this information from our warehouses. The USER may decide to cancel the order request or request an alternative product with similar characteristics.
In any case, the user will be promptly informed of the unavailability of the product. Should the USER not wish to be offered an alternative, a reimbursement will be issued for any payment received within 5 days.
2.4. Refunds and Right to cancellation - The USER -being a individual or company NOT acting in a Merchant or Professional activity- can exercise their right of cancellation and return any product in accordance with the current Distance Selling Regulations. Prior to returning any product, the USER must contact our Customer Service staff: Opening a support ticket preferably: https://aerisco.com/en/support/open-ticket-support. - by phone: 902014561 - by fax: 902022926 to get a cancelation document (RMA).
Any return, cancellation or revocation of the contract of sale must be made by sending that Cancellation or Revocation document (RMA) to Aerisco with the products to return.
In the event that the cancellation or revocation is requested before Aerisco sends the PRODUCT, the USER must contact Aerisco in order to cancel the operation.
Only originally sealed or defective products returns will be accepted. This is why the USER needs to contact Customer Service staff and detail the reasons for the return. In all cases, provided that the right of cancellation is exercised within 7 working days of receiving the order, Aerisco will issue a credit note and reimburse the total amount of the purchase excepting the original shipping costs. The USER will have to pay the shipping costs for returning the PRODUCT. Refunds shall be paid within 5 days of the reception of the returned ORDER.
In the event of a USER receiving a broken, damaged or in poor condition PRODUCT, Aerisco will collect the faulty product and replace it at NO additional cost. Aerisco may terminate the contract before the product is delivered to the USER only if there are strong reasons to believe that the payment method used in the purchase was illegal or invalid. In this case Aerisco will contact the USER and offer an alternative for the suspected irregularity.

3. Personal details protection - In accordance with the Law on the Protection of Personal Details, all the details that have been have willingly provided by the USER will be processed and incorporated into Aerisco's automatic files. In case the USER provide details to request product information or about Aerisco's services or any other matter different than customer / supplier relationship, we understand that the USER give us his/her full consent to process the provided personal details, as detailed in the Protection of Personal Details Law. It will be understood that this conditions are fully accepted once the button "SEND" next to the conditions check box is clicked. The information provided by the USER will be used by Aerisco for the following purposes: 1) sending the information expressly requested. 2) Sending regular newsletter about store information, products of Aerisco, services or news. In any case, the USER can exercise at any time his/her right of access, rectification, cancellation and opposition of the provided information, in accordance with current legislation. 4. Industrial and intellectual property - The intellectual property rights over the work (photographic, literary, audiovisual, etc..), BRANDS and logos contained in Aerisco websites are held exclusively by Aerisco, unless stated differently. Reproduction, distribution, commercialization or transformation of said work constitutes infringement of intellectual property rights from Aerisco or the copyright holders and may lead to the exercise of any judicial or extrajudicial actions they may be entitled in the exercise of their rights. Furthermore, the information which can be accessed through this websites may be protected by intellectual property rights or others. Aerico will not be liable in any case and under no circumstances of infringement of such rights that a USER may commit.

5. Guarantees - The guarantee of the products sold by Aerisco is 2 years for home users as envisaged by the text of the Law for the Protection of Consumers and Users and Other Laws. The guarantee of some consumables (printer consumables, spare bulbs, batteries etc.) will be limited to the period of its life, which is indicated by the manufacturer (3, 6 or 12 months). The warranty for corporate users is the policy established by each manufacturer. The guarantee for used products will be 1 year as envisaged by the text of the Law for the Protection of Consumers and Users and Other Laws. Specifically, when the USER wants to exercise their right to the warranty, the USER will be able to choose between the repair or the replacement of the goods (unless one of these options is impossible or disproportionate), or alternatively between a price reduction or a termination of the contract, all under the terms and conditions set forth in the warranties legislation for consumer goods and other regulations applicable in each case. Aerisco will be responsible for any lack of conformity of the product during the terms and conditions established by law. Similarly, the USER is subject to compliance with the requirements and deadlines prescribed by law for the exercise of these rights. In addition, Article 123.4 of the General Law on Protection of Consumers and Users states: "The consumer and user must inform the seller of the lack of conformity within two months after knowing of it."

6. International Sales - All sales outside the Spanish territory are subject to special shipping costs that will be calculated by Aerisco staff based on the weight and volume of the products requested by the USER after receiving an Order Request. International shipping costs published in the website are merely indicative and approximately correspond to send by regular surface post package. In the event that the automatically calculated shipping costs were incorrect, the USER will receive the correct shipping costs after sending the order request, at which time the USER will have to confirm or cancel the operation. On the other hand, purchases by individuals from any EU countries are subject to applicable taxes. Purchases made by the taxpayers on any of the EU countries will be VAT exempt if the provided VAT number is valid. Purchases made by individuals, both physical and legal residents of countries outside the European Union, are exempted from VAT. Any expenditure that would accrue due to custom rates for the transportation of the products of the country of origin to the destination will be charged to the client if not otherwise agreed. All international sales shall be subject to all the provisions of these General Conditions unless some of the provisions contradict the law of the country of origin of the USER.

7. Applicable law and jurisdiction - These Terms are governed by the Spanish law. For the settlement of any disputes arising from this contract or legal act, the parties may refer to the Consumer Arbitration Board of Madrid, who is entrusted with the appointment of the arbitrator or arbitrators and the arbitration administration. In the event that none of the above systems proves to be effective, companies shall submit the dispute to the Courts and Tribunals of Madrid and expressly renounce to any other jurisdiction that might correspond to them, while consumers shall submit the dispute to the courts and tribunals of the consumer's residence.
